POSHatWork provides you with a ‘Discussion Forum’ to interact with professionals who have registered on this Website. Please note that the ‘Discussion Forum’ is restricted to discussion on the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 and Rules, 2013 (“the Act and Rules”) and other laws related to sexual harassment only.

The Act and Rules clearly states that the identity and addresses of the aggrieved woman, respondent and witnesses, any information relating to conciliation and inquiry proceedings, recommendations of the Internal Committee or the Local Committee, as the case may be, and the action taken by the employer or the District Officer under the provisions of this Act is not published, communicated or made known to the public, press and media in any manner and any person entrusted with the duty to handle or deal with the complaint, inquiry or any recommendations or action to be taken under the law, contravenes the provisions of law, is liable for penalty. The only thing permitted as per law is that information may be disseminated regarding the justice secured to any victim of sexual harassment under this Act without disclosing the name, address, identity or any other particulars calculated to lead to the identification of the aggrieved woman and witnesses.

THE DISCUSSION FORUM IS, THEREFORE, FOR DISCUSSION ON THE LAW ONLY. Hence, while philosophical, technical and other absurdities under the Act and Rules and related laws and procedural lapses can be discussed on this ‘Discussion Forum’, in order to comply with the law and to respect the privacy of individual complainants, respondents and others, we prohibit everyone taking part in discussions on this forum from disclosing facts of any matter and disclosing identity of people (either by taking names or otherwise). We must understand that while freedom of expression is our fundamental right, privacy is also our fundamental right.

3.      Terms and Conditions for ‘Members’:

Section 4 of the Act which deals with constitution of an internal complaints committee (“the ICC”) by an organization states under clause (3) that the ICC must have one member from amongst non-governmental organizations or associations committed to the cause of women or a person familiar with the issues relating to sexual harassment. Rule 4 of the Rules further state that ‘person familiar with issues relating to sexual harassment’ shall be a person who has expertise on issues relating to sexual harassment and may include any of the following: (a) a social worker with at least five years’ experience in the field of social work which leads to creation of societal conditions favourable towards empowerment of women and in particular in addressing workplace sexual harassment and (b) a person who is familiar with labour, service, civil or criminal law.

The intention of the website is only to bring together such external members and provide them with a platform to discuss the law and the complications under it.

As per the provisions of the Act, while external member may include an advocate as well, one must note that the platform provided by this Website is not for the benefit of advertising or soliciting by such advocates as Rule 36 of the Bar Council of India Rules framed under Rule 49 (1) of the Advocate Act, 1961 which deals with standard of conduct and etiquette, prohibits advertising by lawyers. POSHatWork is concerned about the safety and privacy of all its users.

You understand that through your use of POSHatWork you consent to the collection and use of this information for storage, processing, and use by POSHatWork and its affiliates.

6.      Member account, password and security:

You will receive a password and account designation upon completing POSHatWork’s registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify POSHatWork of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. POSHatWork cannot and will not be liable for any loss or damage arising from your failure to comply with this clause.

7.      Member conduct:

You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials (“Content“), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via POSHatWork. POSHatWork is not responsible for Content that you upload, post, email, transmit or otherwise make available via POSHatWork and POSHatWork does not control the Content posted via POSHatWork and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using POSHatWork, you may be exposed to Content that is offensive, indecent or objectionable.   • upload, post, email, transmit, or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment;
  1. use, or cause to be used, POSHatWork to facilitate the transmission of unsolicited or unauthorized material, including but not limited to promotional materials, URLs, junk mail, chain letters, pyramid schemes, or any other form of unauthorized solicitation that you may upload, post, email, transmit, or otherwise make available.
  2. use robots or otherwise harvest others’ email addresses from POSHatWork for purposes of sending unsolicited or unauthorized material.
  3. upload, post, email, or transmit the same message, URL, or post multiple times.
  • disrupt the normal flow of dialogue, or otherwise act in a manner that negatively affects other users’ ability to use POSHatWork;
  • interfere with or disrupt POSHatWork or servers or networks connected to POSHatWork, or disobey any requirements, procedures, policies, or regulations of networks connected to POSHatWork, including using any device, software, or routine to bypass our robot exclusion headers;
  • intentionally or unintentionally violate any applicable local, state, national, or international law, and any regulations having the force of law;
  1. stalk or otherwise harass another; and/or
  • collect or store personal data about other users in connection with the prohibited conduct and activities set forth in paragraphs a through o above.

You acknowledge that POSHatWork may or may not pre-screen Content, but that POSHatWork and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or remove any Content that is available via POSHatWork. Without limiting the foregoing, POSHatWork and its designees shall have the right to remove any Content that violates the Terms and Conditions or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. 8.      International use and export and import compliance:

Recognizing the global nature of the internet, you agree to comply with all local rules regarding online conduct and acceptable Content. You agree to comply with all applicable export and import laws and regulations. In particular, you represent and warrant that you: (a) are not a prohibited party identified on any government export exclusion lists or a member of a government of any other export-prohibited countries as identified in applicable export and import laws and regulations; (b) will not transfer software, technology, and other technical data via POSHatWork to export-prohibited parties or countries; (c) will not use POSHatWork for military, nuclear, missile, chemical, or biological weaponry end uses in violation of U.S. export laws; and (d) will not transfer, upload, or post via POSHatWork any software, technology, or other technical data in violation of U.S. or other applicable export or import laws.

9.      Content submitted or made available:

POSHatWork does not claim ownership of Content you submit or make available for inclusion on POSHatWork. However, with respect to Content you submit or make available for inclusion on publicly accessible areas of POSHatWork, you grant POSHatWork the following worldwide, royalty-free, and non-exclusive license(s), as applicable:

  1. With respect to Content you submit or make available for inclusion on publicly accessible areas of POSHatWork, the license to use, distribute, reproduce, modify, adapt, publicly perform, and publicly display such Content on POSHatWork solely for the purposes of providing and promoting POSHatWork.
  2. With respect to photos, graphics, audio, or video you submit or make available for inclusion on publicly accessible areas of POSHatWork, the license to use, distribute, reproduce, modify, adapt, publicly perform, and publicly display such Content on POSHatWork solely for the purpose for which such Content was submitted or made available.
  3. 11.  Indemnity:

You agree to indemnify and hold POSHatWork and its subsidiaries, affiliates, officers, agents, employees, partners, and licensors harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of Content you submit, post, transmit, modify, or otherwise make available through POSHatWork, your use of POSHatWork, your connection to POSHatWork, your violation of the Terms and Conditions, or your violation of any rights of another.

12.  General Practices Regarding Use and Storage:

You acknowledge that POSHatWork may establish general practices and limits concerning use of POSHatWork, including without limitation the maximum number of days any uploaded Content will be retained by POSHatWork, the maximum number of email messages that may be sent from or received by an account on POSHatWork, the maximum size of any email message that may be sent from or received by an account on POSHatWork, and the maximum number of times (and the maximum duration for which) you may access POSHatWork in a given period of time. You agree that POSHatWork has no responsibility or liability for the deletion or failure to store any messages and other communications or other Content maintained or transmitted by POSHatWork. You acknowledge that POSHatWork reserves the right to deactivate accounts that are inactive for an extended period of time. You further acknowledge that POSHatWork reserves the right to modify these general practices and limits from time to time.

13.  Termination of your account:

POSHatWork, under no circumstances, provides guaranteed membership and may terminate your access to the Website, without cause or notice, which may result in the forfeiture and destruction of all information associated with your account. All provisions of this Agreement that, by their nature, should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14.  Termination:

You may terminate your POSHatWork account, any associated email address, and access to POSHatWork by submitting such termination request to POSHatWork.

As stated above, you agree that POSHatWork may, without prior notice, immediately terminate, limit your access to or suspend your POSHatWork account, any associated email address, and access to POSHatWork. Cause for such termination, limitation of access or suspension shall include, but not be limited to, (a) breaches or violations of the Terms and Conditions or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) discontinuance or material modification to POSHatWork (or any part thereof), (d) unexpected technical or security issues or problems, (e) extended periods of inactivity, (f) engagement by you in fraudulent or illegal activities, and/or (g) nonpayment of any fees owed by you in connection with POSHatWork. Further, you agree that all terminations, limitations of access and suspensions for cause shall be made in POSHatWork’s sole discretion and that POSHatWork shall not be liable to you or any third party for any termination of your account, any associated email address, or access to POSHatWork.

Termination of your POSHatWork account includes any or all of the following: (a) removal of access to all or part of the offerings within POSHatWork, (b) deletion of your password and all related information, files, and content associated with or inside your account (or any part thereof), and (c) barring of further use of all or part of POSHatWork.

15. Terms and Conditions with respect to ‘Shop’:

Pricing:

Prices for products are described on our Website and are incorporated into these Terms and Conditions by reference. All prices are in Indian rupees. Prices, products and Services may change at POSHatWork’s discretion.

Returns/Replacement Policy:

Please note that ‘Return’ is defined as the action of giving back the item purchased by the Buyer to POSHatWork. POSHatWork shall accept replacement of a product in case one of the following situations arise:

  • Item was defective
  • Item was damaged during the Shipping
  • Products was / were missing
  • Wrong item was sent
  • Wrong size of the item was sent

We encourage the Buyer to review the listing before making the purchase decision. In case Buyer orders a wrong item, Buyer shall not be entitled to any replacement. Buyer needs to raise the replacement request within 10 days from the date of payment realization. Once Buyer has raised a return request by contacting us, Buyer shall have the option to exchange the product.

Damaged/ Defective items must be returned in the original condition they were received in with all the accompanying accessories. Replacement facility is available only via self-returns. Pick Up facility is not available on these items.

16.  Cancellation of Fraudulent/Loss to business Orders:

To provide a safe and secure shopping experience, we regularly monitor transactions for fraudulent activity. In the event of detecting any suspicious activity, POSHatWork reserves the right to cancel all past, pending and future orders without any liability. POSHatWork also reserves the right to refuse or cancel orders in scenarios like inaccuracies in pricing of product on website and stock unavailability. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your card has been charged, the said amount will be reversed to your Card Account. Any promotional voucher used for the cancelled orders may not be refunded.

17.  The customer may be considered fraudulent if any of the following scenarios are met:

·         Customer doesn’t reply to the payment verification mail sent by POSHatWork.

·         Customer fails to produce adequate documents during the payment details verification.

·         Misuse of another customer’s phone/email.

·         Customer uses invalid email and phone no.

·         Overuse of a voucher code.

·         Use of a special voucher not tagged to the email ID used.

·         Customer returns the wrong product.

·         Customer refuses to pay for an order.

·         Customer is involved in the snatch and run for any order.

18.  Payments: While availing any of the payment method/s available on the Website, we will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to you due to:

  • Lack of authorization for any transaction/s, or
  • Exceeding the preset limit mutually agreed by You and between “Bank/s”, or
  • Any payment issues arising out of the transaction, or
  • Decline of transaction for any other reason/s

All payments made against the purchases/services on Website by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. Website will not facilitate transaction with respect to any other form of currency with respect to the purchases made on Website.

Before shipping / delivering your order to you, we may request you to provide supporting documents (including but not limited to Govt. issued ID and address proof) to establish the ownership of the payment instrument used by you for your purchase. This is done in the interest of providing a safe online shopping environment to Our Users.

You have specifically authorized POSHatWork or its service providers to collect, process, facilitate and remit payments and / or the Transaction Price electronically or through Cash on Delivery to and from other Users in respect of transactions through Payment Facility.

You understand, accept and agree that the payment facility provided by POSHatWork is neither a banking nor financial service but is merely a facilitator providing an electronic, automated online electronic payment, receiving payment through Cash On Delivery, collection and remittance facility for the transactions on POSHatWork using the existing authorized banking infrastructure and Credit Card payment gateway networks. Further, by providing Payment Facility, POSHatWork is neither acting as trustees nor acting in a fiduciary capacity with respect to the transaction or the transaction price.

Payment Facility for Buyers:

You, as a Buyer, understand that upon initiating a transaction, you are entering into a legally binding and enforceable contract with POSHatWork to purchase the products and/or services from POSHatWork using the Payment Facility, and you shall pay the transaction price through Your Issuing Bank to POSHatWork using Payment Facility.

You, as a Buyer, may agree with the Seller through electronic communication and electronic records and using the automated features as may be provided by Payment Facility on any extension / increase in the Dispatch and/or Delivery time and the Transaction shall stand amended to such extent. Any such extension / increase of Dispatch / Delivery time or subsequent novation / variation of the Transaction should be in compliance with Payment Facility Rules and Policies.

The Buyer acknowledges that POSHatWork will not be liable for any damages, interests or claims etc. resulting from not processing a Transaction/Transaction Price or any delay in processing a Transaction/Transaction Price which is beyond the control of POSHatWork.

Compliance with Laws:

Buyer shall comply with all the applicable laws (including Information and Technology Act, 2000 as amended by the Information Technology (Amendment) Act 2008, Prevention of Money Laundering Act, 2002 and the rules made thereunder, Foreign Contribution Regulation Act, 1976 and the rules made there under, Income Tax Act, 1961 and the rules made there under and Export Import Policy of government of India) applicable to them for using Payment Facility and POSHatWork.

Buyer’s arrangement with Issuing Bank:

All Valid Credit / Debit/ Cash Card/ and other payment instruments are processed using a Credit Card payment gateway or appropriate payment system infrastructure and the same will also be governed by the terms and conditions agreed to between the Buyer and the respective Issuing Bank and payment instrument issuing company.

All Online Bank Transfers from Valid Bank Accounts are processed using the gateway provided by the respective Issuing Bank which support Payment Facility to provide these services to the Users. All such Online Bank Transfers on Payment Facility are also governed by the terms and conditions agreed to between Buyer and the respective Issuing Bank.
